The casino operators, World Interactive Gaming Corporation (WIGC), have argued that because their computers are located and licensed in Antigua, they are not subject to New York gambling laws.
The judge ruled that WIGC has broken both State and Federal gambling laws, including the Federal law on interstate transfers, saying that “The Internet site creates a virtual casino within the user’s computer.”
A hearing in front of a judge will be held to determine restitution of funds to investors, penalties and costs. A preliminary conference is set for September 9.
Virtual casinos are Internet sites that allow all types of bets to be placed by charging them to a credit card or to an account previously established with the casino. They take advantage of the resources of the Internet to freely reach players around the world, even in countries where gambling is prohibited.

What other U.S. city is known for its liberal gambling laws?
New figures show that mobile sports betting generated $1.62 billion in New York between its launch on Jan. 9 and the week ending Jan. 30. In-person sports betting at four upstate casinos added about another $15 million, bringing the monthly total to $1.64 billion.
New Jersey, which had led the nation in the amount of sports bets placed by its casinos and racetracks, had its best month in October 2021, when it took in $1.3 billion in wagers. New Jersey’s figures for January 2022 will be released on February 16.
New York’s mobile sports betting operators took in nearly $113 million in revenue on the $1.62 billion in wagers they handled after paying winners and other expenses. That income is taxed at 51% in New York.
